“Client” means a customer of Umbel.
“Client Data” means information hosted by Umbel on behalf of its Clients.
“Collected Information” means information Umbel collects from Visitors and/or End Users, including Website Navigational Information.
“End User” means an individual that uses the Service.
“Individual” means an individual whose information is collected by Umbel or transferred to us by our Clients.
“Legal Processes” means judicial or other government subpoenas, warrants, court orders or other legal processes.
“Service(s)” means Umbel’s software as a service platform available at https://app.umbel.com.
“Services Agreement” means a written agreement for Service between Umbel and a Client.
“Umbel” or “Company” means Umbel Corp.
“Umbel’s Digital Properties” means, collectively, https://app.umbel.com and www.umbel.com.
“Visitor” means an individual that visits the Website.
“Web Site Navigational Information” means certain information collected by Umbel using tracking technologies, such as cookies or similar technologies.
Umbel’s Digital Properties may contain links to other web sites. Umbel takes reasonable measures to ensure that Umbel’s Digital Properties are free of malware, but Umbel is not responsible for the information practices, content, or terms of service of such other web sites. Umbel encourages you to review the privacy policies of other web sites to understand their information practices and terms of service.
Umbel participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. Umbel is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to the Framework’s applicable Principles. Umbel is responsible for the processing of personal data it receives, under each Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Umbel complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions. With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Umbel is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Umbel may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
We have further committed to refer unresolved privacy complaints under the EU-US and Swiss-US Privacy Shield Principles to an independent dispute resolution mechanism, JAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed by us, please visit the JAMS EU Privacy Shield web site, located at https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim, for more information and to file a complaint.
Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.

Umbel collects name, email, phone number, company/title, and country/state data from anyone interested in our content, webinars, promotions, or demos of the platform.

Umbel uses the data you give us to provide access to the webinars, events, and content (newsletters, blog content, tips, guides, and promotions) you’ve requested. We also use it to contact you with information about future events, webinars, content, and solutions Umbel can provide your business through our direct marketing and sales channels.

The data we collect is processed, stored, and secured by partners who take your privacy as seriously as we do. Umbel vets it’s partners and vendors on at least an annual basis to validate they meet our security standards in terms of data protection.
Do we share or transfer it?
Umbel does not transfer personal data to other third-party controllers or countries outside of the US or the Union.

By consenting, you agree to share name, email, phone number, and professional details with Umbel to send content, event information, offers, opportunities, and direct marketing initiatives. By consenting, you verify you are above the age of legal consent in your country of origin. Umbel maintains the right to reach out for any those reasons until you opt out of future correspondences or until no new events or content are being generated and Umbel is no longer accepting new clients. You may withdraw consent or unsubscribe from content at any time.
Here’s how you control your data:
If you ever wish to change consent or the personal data you’ve shared with us, there are a few different rights you can exercise free of charge. Umbel will respond to a request within 30 days of receipt via the same form of communication Umbel received the request. Let’s break down your rights and how we service each of them.
Right of Access: You have the right to obtain from Umbel confirmation as to whether or not your personal data is being processed, as well as access to the personal data where that is the case. Additionally, you can request the purpose of processing, the categories of data collected, the categories of personal data that is not collected, any recipients to whom the data will be disclosed, the existence of the right to rectification or erasure, the existence of the right to lodge a complaint, and the existence of any automated decision-making.
Right to Rectification: You have the right to obtain from Umbel the rectification of inaccurate personal data. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed by providing a supplementary statement to Umbel.
Right to Erasure: You have the right to have personal data concerning you erased from Umbel’s data stores without undue delay. Additionally, Umbel is obligated to erase personal data without undue delay if:
- the personal data is no longer necessary in relation to the purposes for which it was collected;
- you withdraws consent and there is no other legal ground for the processing;
- you object to the processing and there are no overriding legitimate grounds for the processing;
- the personal data has been unlawfully processed;
- the personal data has to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject;
Right to Restriction of Processing: You have the right to restrict processing of your personal data. Umbel exposes this through our “Edit Preferences” setting in email correspondence. Right to Data Portability: You have the right to request your personal data be ported over to another controller. However, the breadth of personal data stored in Umbel is limited, and does not justify the technical means to port the information in an automated fashion, so Umbel will recommend we delete your personal information instead. If you really want it transferred to another party, we’ll email data fields directly to the new controller and let you know via email or via the same channel the request was made through when it is complete.
Right to Object: You have the right to object to the processing of personal data at any time if you believe data was collected unlawfully. Our team will work with the you directly to investigate the claim and take appropriate action. While the claims are under investigation, the your data will be deleted from Umbel’s stores. If you’d like, you may re-submit your data for access to Umbel content at any time. Additionally, you have the right to lodge a complaint with the Supervisory Authorities.

Web Site Navigational Information
Umbel collects Web Site Navigational Information as you navigate Umbel’s Digital Properties. This section describes the types of Web Site Navigational Information Umbel may collect, typical methods used for collection of such information, and how Umbel may use this information.
As is true of most web sites, we gather certain information automatically and store it in log files. This information may include IP addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. Umbel uses this information for various purposes such as tracking and monitoring End Users’ and Visitors’ activities on Umbel’s Digital Properties. For example, Umbel uses IP addresses to monitor the regions from which End Users and Visitors navigate Umbel’s Digital Properties. We may combine this automatically collected log information with other information we collect about you. We do this to improve Services, to improve marketing, analytics, and site functionality.
To opt out of Google Analytics for display advertising or customize Google display network ads, you can visit the Google Ads Settings page. Please note that to the extent advertising technology is integrated into the Platform, you may still receive advertisements even if you opt-out of tailored advertising. In that case, the ads will just not be tailored. Also, we do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms.
Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL UMBEL BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE WEBSITE OR MATERIALS ON THIS WEBSITE, EVEN IF UMBEL OR AN UMBEL AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Data Collected By Clients
the Services Agreement (or similar agreement), or as may be required by Legal Processes, and will host Client Data solely to facilitate the processing and use of the Client Data by its Clients. Individual records of Client Data may be viewed or accessed by Umbel only for the purpose of resolving a problem, support issues, or suspected violation of the Services Agreement, or as may be required by Legal Processes. End Users are responsible for maintaining the security and confidentiality of their Umbel usernames and passwords. If Client Data includes personally identifiable information subject to the protections of the European Union’s Data Protection Directive, Client will remain responsible for such information vis-à-vis the Individual in accordance with the relevant EU provisions, although, as set forth in the Services Agreement, Umbel will cooperate with the Client as may be necessary to ensure that individuals’ rights to access and correct such information are respected. Umbel permanently deletes or destroys Client Data residing on its servers promptly upon the termination of a Client relationship.
Information Related to Data Collected for our Clients
Umbel collects information under the direction of its Clients, and has no direct relationship with the individuals whose personal data it processes. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Clients.
Umbel may also obtain some information about Individuals from third party sources for analysis and to better understand the Individuals’ social presence on behalf of our Clients. If you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our Service, please contact the Client that you interact with directly.
Access and Retention of Data Controlled by our Clients
Umbel acknowledges that you have the right to access your personal information. Umbel has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his or her query to Umbel’s Client (the data controller). If the Client requests Umbel to remove the data, we will respond to its request within 30 days.
We will retain personal data we process on behalf of our Clients only for as long as needed to provide services to our Client. Umbel will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our Service Agreements.
The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. Although we strive to make security a priority, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. We may retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes and enforce our agreements.
